Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Nest Project (the “Service”). By creating an account or otherwise using Nest Project, you agree to these Terms. If you do not agree, please do not use the Service.

1. The service

Nest Project is an independent tool operated by William Panggadewa that lets you track your net worth and investments and model compound-interest scenarios. It is provided for personal, educational, and informational use only.

2. Not financial advice

Nest Project does not provide financial, investment, tax, or legal advice, and is not a broker, dealer, financial adviser, or investment platform. All figures, tools, prices, and projections are for illustration and general information only, and must not be relied upon as the basis for any financial decision. You are solely responsible for your own decisions and should consult a qualified professional where appropriate. Please also read our Disclaimer.

3. Eligibility

You must be able to form a legally binding contract to use Nest Project. If you are a minor under the law of your jurisdiction, you may use Nest Project only with the consent and supervision of a parent or legal guardian.

4. Your account

You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
You agree to provide accurate information and to notify us of any unauthorised use of your account.
You are responsible for the data you enter, including its accuracy.

5. Acceptable use

You agree not to:

use the Service for any unlawful, harmful, or fraudulent purpose;
attempt to gain unauthorised access to the Service, other users’ data, or our systems;
interfere with, disrupt, overload, or reverse-engineer the Service;
copy, scrape, resell, or exploit the Service or its data other than as permitted; or
misuse or attempt to circumvent any security features or usage limits.

6. Market data and third-party services

Nest Project displays prices and information obtained from third-party sources and relies on third-party providers (such as Google Firebase and Cloudflare) to operate. This data and these services are provided “as is”, may be delayed or inaccurate, and may be unavailable at times. We are not responsible for the content, accuracy, or availability of third-party data or services.

7. Intellectual property

The Service, including its design, text, and software, is owned by Nest Project and protected by applicable laws. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Service for its intended purpose. The financial data you enter remains yours.

8. Availability and changes

Nest Project is offered on an ongoing but “as available” basis. We may modify, suspend, or discontinue any part of the Service, and may update these Terms, at any time. If we make material changes, we will update the “last updated” date below. Your continued use after changes take effect constitutes acceptance of the revised Terms.

9. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including as to accuracy, reliability, fitness for a particular purpose, or uninterrupted or error-free operation.

10. Limitation of liability

To the fullest extent permitted by law, Nest Project and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, savings, data, or investment losses, arising out of or relating to your use of, or inability to use, the Service — even if advised of the possibility of such damages. Any financial decisions you make are made at your own risk.

11. Termination

You may stop using Nest Project and request deletion of your account at any time. We may suspend or terminate your access if you breach these Terms or misuse the Service.

12. Governing law

These Terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service shall be subject to the jurisdiction of the courts of Thailand.

5. การใช้งานที่ยอมรับได้

คัดลอก ดึงข้อมูล ขายต่อ หรือแสวงหาประโยชน์จากบริการหรือข้อมูล นอกเหนือจากที่ได้รับอนุญาต
ใช้ในทางที่ผิดหรือพยายามหลบเลี่ยงคุณลักษณะด้านความปลอดภัยหรือขีดจำกัดการใช้งานใด ๆ

6. ข้อมูลตลาดและบริการของบุคคลที่สาม

Nest Project แสดงราคาและข้อมูลที่ได้จากแหล่งของบุคคลที่สาม และพึ่งพาผู้ให้บริการบุคคลที่สาม (เช่น Google Firebase และ Cloudflare) ในการดำเนินการ ข้อมูลและบริการเหล่านี้ให้ “ตามสภาพ” อาจล่าช้าหรือคลาดเคลื่อน และอาจใช้งานไม่ได้ในบางเวลา เราไม่รับผิดชอบต่อเนื้อหา ความถูกต้อง หรือความพร้อมใช้งานของข้อมูลหรือบริการของบุคคลที่สาม

10. การจำกัดความรับผิด

เท่าที่กฎหมายอนุญาตสูงสุด Nest Project และผู้ดำเนินการจะไม่รับผิดต่อความเสียหายทางอ้อม ที่เป็นผลสืบเนื่อง โดยบังเอิญ พิเศษ หรือเชิงลงโทษ หรือการสูญเสียกำไร เงินออม ข้อมูล หรือการขาดทุนจากการลงทุน ที่เกิดจากหรือเกี่ยวข้องกับการใช้ หรือการไม่สามารถใช้บริการได้ แม้จะได้รับแจ้งถึงความเป็นไปได้ของความเสียหายดังกล่าวแล้วก็ตาม การตัดสินใจทางการเงินใด ๆ ที่คุณทำถือเป็นความเสี่ยงของคุณเอง

11. การยกเลิก

คุณสามารถหยุดใช้ Nest Project และขอให้ลบบัญชีของคุณได้ทุกเมื่อ เราอาจระงับหรือยกเลิกการเข้าถึงของคุณ หากคุณละเมิดข้อกำหนดเหล่านี้หรือใช้บริการในทางที่ผิด

12. กฎหมายที่ใช้บังคับ

ข้อกำหนดเหล่านี้อยู่ภายใต้บังคับของกฎหมายแห่งราชอาณาจักรไทย โดยไม่คำนึงถึงหลักการขัดกันแห่งกฎหมาย ข้อพิพาทใด ๆ ที่เกิดจากข้อกำหนดเหล่านี้หรือจากบริการจะอยู่ภายใต้เขตอำนาจของศาลไทย
